Believe it or not, the meaning behind the hearsay rule isn’t to confuse and frustrate you. Instead, hearsay serves a very important purpose during a jury trial (or mock trial).
In fact, if you throw out the confusing language of the "truth of the matter asserted" and substitute it with normal English, then you’ll see that the hearsay definition is relatively straightforward.
In this video, we discuss all of this and more.
I highlight each rule under hearsay and provide some hearsay examples of out of court statements as well.
This includes FRE 801 (hearsay definition + nonhearsay), FRE 802, FRE 803 (hearsay exceptions), FRE 804 (hearsay exceptions), FRE 805, FRE 806, and FRE 807. That way you can better spot hearsay evidence whenever it comes up!
With this hearsay guide and video, I’m hoping that this trial objection is no longer the most confusing one out of the Federal Rules of Evidence.
